Litigation
Raymond P. Niro, Jr. and his team of associates have successfully litigated intellectual property cases throughout the country. Niro has a proven track record of winning for individual clients, as well as Fortune 500 companies, on both the plaintiff’s and defense’s side.
One thing is certain: Niro will relentlessly protect his clients’ interests no matter how big the opponent is or how long it takes to secure victory. In a recent case, Niro represented a small Chicago company for 9 years of litigation (which included multiple IPRs, claim construction, summary judgment, jury trial, and appeals) after which the defendant was forced to pay the entire amount of the judgment with interest.
Based in Chicago Illinois, Niro frequently litigates against the largest law firms in the country … and wins! As one client said: “Litigation can be similar to a UFC fight, where one camp might have hundreds of support personnel, but in the end, it’s one-on-one in the ring, and I would choose Niro every time in that battle.”
In the past several years, Niro has won a string of multimillion-dollar jury verdicts, including two among the Top 100 Verdicts in the country. On October 5, 2015, Niro won a $ 54 million jury award for his client Black & Decker on the yellow and black color scheme for its DeWalt line of power tools – – one of the largest trademark infringement verdicts in history.
On September 18, 2019, Niro achieved a judgment of $ 4.3 million dollars for Chicago-based Kolcraft Enterprises, on a patent for children’s products. In Niro’s first trial as lead counsel 20 years ago, he won a jury verdict of $ 2.1 million for Chicago company Control Alt Design, where the jury also found willful infringement, allowing the court to increase damages to $ 6.3 million.
Utilizing a streamlined, efficient approach to litigation, Raymond P. Niro, Jr. directly participates in all stages of the litigation process, from the pre-filing investigation to the appeal. He personally appears at the status conferences, takes the depositions, makes the oral arguments, writes the brief, and, most importantly, tries the cases … all with help from his associates and support staff.
Niro communicates openly and honestly with his clients at each step of the litigation process, making adjustments, if necessary, as the landscape changes.
Niro offers representation on a contingent-fee basis, hourly billing, or hybrid, depending on the client’s needs and the circumstances of the individual case.
